Terms of Use

A. General

giftup.in(the "Platform") is an internet-based portal operated by Binar Inovasyon Private Limited(the "Company"), providing access to digital gift card purchase and management services under the brand name GiftUp. By accessing or using the Platform, you agree to be bound by these Terms of Use. If you do not agree, please do not use the Platform.

B. Communications

By registering on the Platform, you consent to receiving communications from us, including transactional emails, order updates, promotional offers, and service announcements via email or SMS. You may opt out of promotional communications at any time by using the unsubscribe option in our emails or by contacting us at contact@giftup.in. Transactional communications related to your orders cannot be opted out of.

C. Platform Services

GiftUp operates as a digital gift card marketplace, enabling users to browse, purchase, and receive e-gift cards from various Indian and international brands. Gift cards are digital products delivered electronically to your registered account and email address. No physical cards are shipped. The Company acts as a facilitator between users and gift card issuers and does not itself issue the gift cards.

D. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.

E. User Obligations

As a user of the Platform, you agree not to:

• Modify, copy, distribute, or create derivative works from any content on the Platform without prior written consent.
• Reverse engineer, decompile, or attempt to extract the source code of any software used in the Platform.
• Use the Platform to infringe upon the intellectual property rights of the Company or any third party.
• Upload, transmit, or distribute any malware, viruses, or harmful code.
• Engage in any fraudulent activity, including but not limited to using stolen payment credentials or attempting to exploit system vulnerabilities.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use automated tools, bots, or scrapers to access the Platform without authorisation.
• Violate any applicable local, state, national, or international law.

F. Usage Conduct

You are responsible for maintaining the necessary hardware, software, and internet connectivity required to access the Platform. Use of the Platform is restricted to lawful, personal, and non-commercial purposes unless otherwise agreed in writing. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

G. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and design elements, is the property of Binar Inovasyon Private Limited or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or publicly display any materials from the Platform without our prior written consent. The GiftUp name, logo, and all related marks are trademarks of Binar Inovasyon Private Limited.

H. Gift Card Terms

Each gift card purchased through the Platform is subject to the terms and conditions of the respective brand or issuer. These may include restrictions on usage, validity periods, minimum/maximum amounts, and redemption rules. The Company provides a storage facility for your purchased gift card details within your account dashboard. While we implement reasonable security measures, the Company does not assume liability for losses arising from unauthorised access to your account due to circumstances beyond our control.

I. Payment Terms

All prices on the Platform are displayed in Indian Rupees (INR). Payments are processed through secure, PCI-DSS compliant third-party payment gateways. We do not store your payment card details, UPI IDs, or banking credentials. A platform convenience fee may apply for certain orders, which will be clearly displayed before checkout. Prices and discounts are subject to change without prior notice.

J. Third-Party Links

The Platform may contain links to external websites or services operated by third parties. These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites. Accessing these links is at your own risk.

K. Disclaimer of Warranties

The Platform and all services are provided on an "as is" and "as available" basis. The Company does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. We make no representations regarding the accuracy, completeness, or reliability of any content or information on the Platform. Your use of the Platform is at your sole risk.

L. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim related to the Platform shall not exceed the amount paid by you for the specific transaction in question.

M. Indemnification

You agree to indemnify, defend, and hold harmless Binar Inovasyon Private Limited, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your breach of these Terms, your use of the Platform, or your violation of any applicable law or third-party rights.

N. Termination

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without prior notice, for any reason including but not limited to breach of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall continue to remain in effect.

O. Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting on this page. Your continued use of the Platform after any modifications constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

P. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.
